(A) A Board of Metropolitan Police Commissioners shall be established for the Town of Sheridan and three Commissioners shall be appointed by the Town Council pursuant to IC 36-8-9-3.
(B) Each Board member must be a resident of the town.
(C) After the initial appointments, the term of each Board member shall expire January 1 of the third year after the member's appointment. The terms must stagger for each member. The first appointments must be as follows:
(1) One member shall serve for one year from January 1, 2022 to December 31, 2022;
(2) One member shall serve for two years from January 1, 2022 to December 31, 2024; and
(3) One member shall serve for three years from January 1, 2022 to December 31, 2025.
(D) The Town Council may remove a Board member for any cause that the Council considers sufficient.
(E) The Town Council may not appoint a police officer employed by the town to serve on the Board.
(F) A member of the Council may serve as an ex officio member of the Board. A maximum of two Council members can be concurrent Board members. A Council member may no longer serve on the Board if he/she vacates his/her position on the Council, unless the active members of the Council vote to allow the member to finish the remainder of his/her term. Council members on the Board may not receive compensation as a Board member and are not required to post a bond.
(G) Before performing any function of a Board member, an individual shall take and swear an oath or affirmation before the Circuit Court Clerk of Hamilton County. The Circuit Court Clerk shall file oaths and affirmations among the Circuit Court Clerk's records.
(H) A Board member shall give a bond in the penal sum of $5,000, payable to the state and conditioned upon the faithful and honest discharge of the member's duties. The bond must be approved by the Council.
(I) The initial salary of the members of the Board of Metropolitan Police Commissioners shall be $0.
(J) The Town of Sheridan's Board of Metropolitan Police Commissioners shall be governed by IC 36-8-9 et seq. and all future amendments.
