§ 31.25 OTHER AUTHORIZED LEAVE.
   (A)   All officers and employees to whom § 31.23 applies shall be permitted five personal days per year.
   (B)   All officers and employees to whom § 31.23 applies shall be permitted reasonable amounts of time for the following purposes:
      (1)   Maternity.
      (2)   Illness in the immediate family, when the officer’s or employee’s presence is necessary to care for the ill family member.
      (3)   Death in the immediate family.
      (4)   Required military service.
      (5)   Jury duty.
      (6)   Testifying in court, when required by subpoena (when an officer or employee is required to testify or appear in court in connection with his or her official town duties, the appearance will not be considered as leave time).
      (7)   Religious observances not incorporated under declared town holidays.
      (8)   Any other purposes approved by the Town Council.
   (C)   Any officer or employee may opt to use any paid vacation days under § 31.23 for any of the purposes described in division (A) above, and also may opt to use any paid sick days accruing or granted under § 31.24 for the purposes described by divisions (A)(1) through (3) of this section. Otherwise, leave permitted and approved under this section shall be without pay unless otherwise expressly provided by the Town Council.
   (D)   Requests for leave under this section must be approved by the employee’s department head or chief supervisor and, in case of a department which is under the direction of an executive commissioner, also by the commissioner. In the case of an officer or department head not otherwise having a supervisor, the request must be approved by the Town Council President.
   (E)   Denial or restriction of requests for leave under this section may be appealed to the full Town Council. The Clerk-Treasurer must be notified of leave granted for payroll accounting purposes.
