§ 10.17 ORDINANCES WHICH AMEND OR SUPPLEMENT CODE.
   (A)   If the Town Council shall desire to amend any existing chapter or section of this code, the chapter or section shall be specifically repealed and a new chapter or section, containing the desired amendment, substituted in its place.
   (B)   Any ordinance which is proposed to add to the existing code a new chapter or section shall indicate, with reference to the arrangement of this code, the proper number of such chapter or section. In addition to such indication thereof as may appear in the text of the proposed ordinance, a caption or title shall be shown in concise form above the ordinance.
   (C)   The Town Council shall, from time to time, provide for the compilation of supplement volumes incorporating or reflecting any additions to, amendments or repeals of the provisions of this code enacted subsequent to its original adoption. A code supplement volume shall be published in the same manner as the original code, as provided in division (A) above. ('85 Code, § 1-2-10)
   (D)   Unless a supplementary ordinance includes a provision delaying its effectiveness to a specified date, or provides for or increases the penalty for violation of any penal provision of this code and is so required to be published or promulgated before taking effect, pursuant to IC 36-5-2-10(b), then the supplementary ordinance shall be effective and the code shall be considered as concurrently amended, upon the passage, signature and recording of the supplementary ordinance as provided by law. If a supplementary ordinance is required to be published or promulgated in accordance with IC 36-5-2-10(b), it shall not be effective until:
      (1)   The ordinance or substantive digest thereof setting forth the penalties is published in accordance with IC 36-5-2-10(b) and IC 5-3-1; or,
      (2)   The provisions of the supplementary ordinance are included in a code supplement volume, which is compiled and published in accordance with division (C) above, as provided by IC 36-5-2-10(b)(1); or,
      (3)   A provision of the supplementary ordinance declares an emergency and copies of the adopted ordinance are posted in accordance with IC 36-5-2-10(b)(2).
