The franchise holder shall provide and use, for the purpose of the disposal of the garbage collected, a solid waste disposal site or facility approved by and under the regulations of the Kentucky Department of Health and any applicable state laws, or if located outside of Kentucky, the regulations and state laws of the state where the disposal site or facility is located. In addition, the franchise holder shall comply with all laws, ordinances and regulations applying to its activities under this franchise, and shall be subject to the authority of the Commonwealth of Kentucky and the Shelby County Board of Health. This franchise specifically excludes the collection of medical or toxic waste, as those terms are defined in the Kentucky Revised Statutes.
