(A) The Erosion and Sediment Control Plan submitted to the MS4 Operator shall include all documents and information required within 327 I.A.C. 15-5.
(B) No person shall be granted a site development permit without the approval of an Erosion and Sediment Control Plan by the Shelbyville MS4 Operator for land-disturbing activity uncovering one or more acres of land. (Individual building lots less than one acre, see division (C).)
(C) The developer of an individual building lot containing less than one acre, but which is a part of a multi-lot construction project permitted under division (B) of this section, shall be required to complete a declaration of responsibility for erosion and sediment control for a small residential lot prior to receipt of a location improvement plan. This declaration assigns responsibility for conformance to the Construction Plan as required in 327 I.A.C. 15-5-7.5 to the individual building lot developer.
(D) No site development permit is required for the following activities:
(1) Any emergency activity that is immediately necessary for the protection of life, property or natural resources; and
(2) Existing nursery and agricultural operations conducted as a permitted main or accessory use.
(E) Each site development permit application shall bear the name(s) and address(es) of the owner or developer of the site and of any consulting firm retained by the applicant together with the name of the applicant's principal contact at such firm and shall be accompanied by a filing fee in accordance with Exhibit A, on file in the office of the City Clerk.
(F) The applicant will be required to file with the city a faithful performance or maintenance bond, letter of credit or other improvement security in an amount deemed sufficient by the MS4 Operator to cover all costs of improvements, landscaping, maintenance of improvements for such period as specified by the city and engineering and inspection costs to cover the cost of failure or repair of improvements installed on the site.
