§ 152.17 BUILDING COMMISSION.
   (A)   Creation of Commission.
      (1)   There is hereby created the Shelbyville Building Commission. The Commission shall consist of seven voting members and two nonvoting members. The Mayor shall appoint the seven voting members, each to serve a term of four years. The Building Commissioner, or his or her designee and a representative of the Shelbyville Fire Department shall serve as the nonvoting members of the Commission.
      (2)   The appointed members of the Commission must include the following:
         (a)   One building contractor who is registered with the Building Department;
         (b)   One electrical contractor who is the holder of a Class I license;
         (c)   One plumbing contractor who is registered with the Building Department;
         (d)   One HVAC contractor who is actively engaged in the installation of heating and cooling equipment;
         (e)   One member shall be a designer of buildings;
         (f)   One member shall be a citizen representative of the city; and
         (g)   One member shall be a representative of a local utility company.
      (3)   Each appointed member of the Commission must have a recognized interest, knowledge, and experience in the field of fire prevention, fire protection, building safety, or other related matters. No two members of the Commission shall be appointed from the same firm. Of the seven members originally appointed, one shall be appointed for a term of one year, two shall be appointed for a term of two years, two for a term of three years, and two for a term of four years. Each appointment thereafter shall be for a term of four years, or until a successor is appointed. The members of the Commission serve at the pleasure of the Mayor.
   (B)   Powers and duties. It shall be the duty of the Building Commission to:
      (1)   Appoint one or more Commission members as a technical/special trade consultant to the Board of Public Works and Safety when requested by the Board of Public Works and Safety.
      (2)   Issue building contractor registrations as described in Chapter 152, plumbing registrations as described in Chapter 154, and electrical licenses as described in Chapter 155.
      (3)   Act as the appellate authority on all appeals of license and permit denials and grants.
      (4)   Make recommendations to the City Council for changes in fees and ordinances.
      (5)   Establish department policies and procedures for inspections, permits, licenses and registrations.
Wherever the term Electrical Examining Board is used, it shall mean the Building Commission.
   (C)   Meetings. The Commission shall hold a regular meeting at least once during each month, and may hold special meetings at the call of the Building Commissioner, or at the written request of at least two voting members of the Commission. The Commission shall annually elect a chairperson from among its members. The Building Commissioner shall record the minutes of the meetings. Four voting members present at any meeting shall constitute a quorum for the transaction of business, but any action taken at any meeting shall require the affirmative vote of at least four voting members. In the case of a tie vote on an action of the Commission, the Building Commissioner shall cast the deciding vote.
