(A) It is the purpose of this subchapter to benefit the residents of the city as a whole by identifying sidewalk café, outdooor dining and promoting pedestrian traffic in commercial areas, enhancing the attractiveness of the downtown business zone; and making beverages and food conveniently available for members of the public, without creating a health or safety hazard or inconveniencing pedestrians.
(B) As used in this subchapter, the following terms shall have the meanings ascribed to them in this section.
ABUTTING BUSINESS PROPERTY. Any real property which is used for retail business, which abuts (but is not located in) the public sidewalk area.
CAFÉ ACTIVITY. The retail sale of non-alcoholic beverages or food, or the provision of a place for the consumption of beverages or food.
CAFÉ AREA. The area used for café activity and shall include the sidewalk area from the abutting business property extending toward the curb which provides both adequate seating capacity and effective walkway width of the public sidewalk area.
EFFECTIVE WALKWAY WIDTH. That portion of the sidewalk in the public sidewalk area that is reasonably available for use by the pedestrian stream to move unencumbered through the area.
PUBLIC SIDEWALK AREA. A sidewalk area located in the public right-of-way or in an area in which the public has an easement for sidewalk purposed, or both.
SEATING CAPACITY. For consumption of non-alcoholic beverages or food shall be limited by a 2:1 ratio (two seats per each linear foot of building frontage).
SIDEWALK SALES AREA. The portion of the public sidewalk which has been registered with the Board of Public Works and Safety for the purpose of providing a café area.
