§ 35.067 DEFINITIONS.
   For the purpose of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BARGAINING UNIT. All members of the Fire Department except:
      (1)   The Fire Chief.
      (2)   Any member with less than one year seniority.
      (3)   Any clerical personnel.
   CITY. The city of Shelbyville and those officially designated persons by the Mayor, who shall act on behalf of the city on all factors.
   COLLECTIVELY BARGAIN or BARGAIN. The performance by the city and the exclusive representative of the mutual obligation:
      (1)   To meet at reasonable times, including meetings in advance of the budget-making process; and
      (2)   To negotiate in good faith with respect to wages, rates of pay, hours of employment, fringe benefits, working conditions, and all other terms and conditions of employment excepting only pensions or other items provided by state or federal law. However, this obligation does not require either party to make a concession.
   EXCLUSIVE REPRESENTATIVE. The officers of the Shelbyville Professional Fire Fighters Association, Local 2008, selected by the majority of the fire fighters to represent them as to wages, hours of employment, fringe benefits, working conditions, and all other terms and conditions of employment excepting only pensions or other items provided by state or federal law.
   FACTORS. Wages, rates of pay, hours of employment, fringe benefits, working conditions, and all other terms and conditions of employment, excepting only pension or other terms provided by state or federal law.
   FIRE FIGHTERS. The permanent members of the Fire Department in the bargaining unit.
   STRIKE. Any group action or refusal to act, which results in any interference with normal activity of the department, such as, but not limited to, willful absence from one’s position, sick-in, stoppage of work, abstinence or interference in whole or in part from full, faithful, and proper performance of duties of employment without the lawful approval of the city.
