§ 32.45 SEEKING DESIGNATION AS AN ECONOMIC REVITALIZATION AREA.
   (A)   Any person, or entity, seeking designation as an economic revitalization area shall file a petition seeking such a designation with the Council in the form required by I.C. 6-1.1-12.1-1.
   (B)   Any person, or entity, seeking tax abatement shall file a petition seeking such a designation with the Council in the form required by I.C. 6-1.1-12.1-1. If, the property for which tax abatement is sought is already within an economic revitalization area, a notice and hearing for remonstrance are not required.
   (C)   Any person, or entity, seeking designation as an economic revitalization area, shall file a preliminary resolution for the designation of an economic revitalization area. Such person(s) or entities shall thereafter appear before the City Council of the city for initial approval of such Resolution. The resolution shall accompany the filing of the initial petition for designation as an economic revitalization area.
   (D)   Notice of such filing of the resolution shall thereafter be made pursuant to I.C. 5-3-1. Publication of the notice shall not be less than ten days prior to final action by the City Council.
   (E)   Final action, in the form of a resolution, approving the action sought, shall be made at the next regularly scheduled City Council meeting, unless, for good cause shown, this procedure is modified by the City Council.
