(A) Any person who shall own, keep, or harbor a dog over the age of three months within the village shall within ten days after acquisition of the said dog, acquire a license for each such dog annually by or before April 1 of each year. The said tax shall be delinquent from and after April 10; provided the possessor of any dog brought into or harbored within the corporate limits subsequent to April 1 of any year, shall be liable for the payment of the dog tax levied herein and such tax shall be delinquent if not paid within 30 days from the date the dog is brought into the village. All dogs owned or harbored in the village on which taxes are delinquent may be put to death in a humane manner at the order of the governing body. Licenses shall be issued by the Village Clerk upon the payment of the license fee of $5 for each dog. Said license shall not be transferable and no refund will be allowed in case of the death, sale, or other disposition of the licensed dog. The owner shall state at the time the application is made upon printed forms provided for such person, his or her name and address and the name, breed, color, and sex of each dog owned and kept by him or her. A certificate that the dog has had a rabies shot effective for the ensuing year of the license shall be presented when the license is applied for and no license or tax shall be issued until the certificate is shown.
(B) In addition to the rabies vaccination certificate, the owner shall bring the dog to the village office at the time of licensing for a photo identification to be kept on file in the village office to aide in the identification of dogs picked up by animal control authorities.
(C) Each dog owner as a requirement of obtaining a license shall be required to provide liability insurance in an amount of not less than $300,000 which policy shall insure third parties against personal injuries and property damages caused by said dog. At the time of licensing a certificate of insurance shall be provided to the village from an insurance company licensed to do business in Nebraska. The village shall be notified in the event of cancellation of said insurance policy by the owner of the licensed dog. In the event the policy of insurance is cancelled and no replacement policy is issued within three days of cancellation, the license shall be revoked, the dog shall be deemed a nuisance and removed from the village limits by the dog owner without further notice.
(D) This section shall apply to all new dog licenses issued after the passage of this ordinance as codified herein. Dog licenses currently in effect shall be subject to the new requirements provided herein at the time the license is renewed.
