§ 54.04  RATES.
   (A)   Every person who owns, occupies, inhabits, uses, or possesses any residence, apartment, building, commercial establishment, business, school, institution, or any other improved premises within the corporate limits of the village, shall pay a garbage fee as assessed and determined by the Board of Trustees. In the case of property leased by an owner thereof to a tenant, the garbage fee shall be paid for by the owner. The rates shall be on file in the office of the Village Clerk for public inspection during office hours with the monthly rates being as follows:
 
Businesses, schools, and institutional services (once a week pickup) per month
$27 per yard (based on container size)
Businesses, schools, and institutional services (twice a week pickup) per month
$39.25 per yard (based on container size)
Residential services (family)
$20.50 per month
Residential services (couple)
$19 per month
Residential services (individual)
$17.50 per month
For 2 carts
$6 per month extra
Rates are effective January 1, 2019
 
   (B)   The village reserves the right to be exercised by resolution to contract and charge separately and on such terms as may be contained in said resolution with all persons, businesses, entities, commercial establishments, or institutions who generate unusual or hazardous kinds or unusually large amounts of garbage, rubbish, solid waste, or refuse. Said resolution shall not be adopted until appropriate notice and opportunity for hearing have been given to such persons, entities, businesses, institutions, or commercial establishments generating unusual or hazardous kinds or unusually large amounts of garbage, rubbish, solid waste, or refuse.
   (C)   Upon written application to the Board of Trustees, a property owner of any residence, apartment, house, mobile home, building, or institution may obtain a waiver of the garbage fee provided that each of the following conditions are satisfactorily proven to the Board of Trustees, to-wit:
      (1)   The residence, house, apartment, building, or institution is unoccupied for the entire month: and
      (2)   There is no garbage, rubbish, solid waste, or refuse of any kind generated within or without said improvement.
   (D)   The waiver of the garbage assessment fee shall be effective only during the period of time both of the conditions in division (C) above are satisfied.
   (E)   The monthly garbage assessment fee shall be paid quarterly, in advance, on May 1, 1994, for the months of May and June 1994; thereafter, the bills will be consolidated with the municipal water bills and be payable in advance on July 1, October 1, January 1, and April 1 of each year. Payment shall become delinquent if not paid by the tenth of the month in which they are due and, in such case, a late payment fee shall be assessed in the amount of $5 to such property owner.
   (F)   In the event such garbage assessment fees are not paid when due, the village may recover said amounts from the owner by filing a civil action or, following notice by regular United States mail to the last known address of the property owner of record and an opportunity for hearing, such unpaid amounts for garbage services may be certified by the Board of Trustees to the County Treasurer and assessed against the premises served and collected or returned in the same manner as other taxes are certified, assessed, collected, and returned.
