§ 54.03  INTEGRATED SOLID WASTE MANAGEMENT PLAN.
   (A)   The village hereby adopts a solid waste management plan which consists of a system for collection, source separation, storage, transportation, transfer, processing, treatment, and disposal of solid waste generated within the corporate limits of the village through the utilization of a contract for all such services with an authorized and approved garbage hauling and disposal contractor. The garbage hauling and disposal contractor selected by the village shall comply with all federal, state, county, and municipal laws, ordinances, together with all rules and regulations adopted by any governmental authority regulating the transportation and disposal of garbage, solid waste or refuse of any kind in the State of Nebraska. The Board of Trustees from time to time shall execute appropriate contracts with approved garbage hauling and disposal contractors for all such transportation and disposal services, and a copy of the executed contract for solid waste, transportation, and disposal services shall be kept on hand at the office of the Village Clerk for public inspection during office hours.
   (B)   The garbage hauling and disposal contractor authorized and approved by the village for transportation and disposal services shall transport and dispose of all garbage, rubbish, solid waste, and refuse of any kind generated within the corporate limits of the village and permitted to be deposited in a landfill licensed by the State of Nebraska. Each person who owns, occupies, inhabits, uses, or possesses any residence, apartment, building, commercial establishment, business, school, institution, or any other improved premises within the corporate limits of the village, or leases to someone who occupies such premises, must use the authorized and approved garbage hauling and disposal contractor for the transportation and disposal of all garbage, rubbish, solid waste, and refuse of any kind generated thereon, except such solid waste that is not lawfully deposited in landfills licensed by the State of Nebraska.
   (C)   It shall be unlawful to permit or allow any unauthorized garbage hauling or disposal person, entity, or contractor to collect, transport, or dispose of any garbage, rubbish, solid waste, or refuse of any kind from any residence, apartment, building, commercial establishment, business, school, institution, or any other improved premises within the corporate limits of the village.
   (D)   This section shall not be construed to prohibit individuals, businesses, or firms from collecting materials such as metals, glass, plastic, and newspapers which have been separated at their source for delivery to recycling centers, or individuals, businesses, and firms which use such materials as raw products in their manufacturing process.
