§ 51.23  CONSTRUCTION OF WATER WELLS.
   (A)   Construction of a water well of any kinds shall be prohibited within the village limits or within one mile of said village limits unless the Village Board has approved by a majority vote. The well driller must first obtain written permission of the Village Board before constructing the well.
   (B)   The water well must be located and constructed according to Title 178, Nebraska Department of Health/Housing and Environmental Services/Regulations, Chapter 9 - Rules and Regulations governing a private well.
   (C)   Any well installed and operated without having first obtained a permit from the village shall be deemed a nuisance and the Board of Trustees shall abate such facility as a public nuisance pursuant to § 91.02 of this code of ordinances.
