3-2-1: DEFINITIONS:
As used in this chapter, the following words and terms shall have the meanings ascribed to them in this section, unless the context otherwise indicates. All other words and phrases used in this chapter, the definitions of which are not given herein, shall be given the ordinary meaning:
ALCOHOL: Ethyl alcohol, also called ethanol or the hydrated oxide of ethyl.
ALCOHOLIC BEVERAGE: A compound produced and sold for human consumption as a drink that contains more than one-half of one percent of alcohol by volume.
BEER: A malt beverage containing not more than seven percent (7%) of alcohol by weight.
DEPARTMENT: The Montana department of revenue.
LIQUOR: Any alcoholic beverage except beer and table wine.
PERSON: Every individual, partnership, corporation, hotel, restaurant, club and fraternal organization, and all licensed retailers of liquor, whether conducting the business singularly or collectively.
PUBLIC PLACE: A place, building, or conveyance to which the public has or may be permitted to have access and any place of public resort.
RESIDENCE: A building, part of a building or tent where a person resides, but does not include any part of a building that is not actually and exclusively used as a private residence.
RETAILER: Any person, club, association, fraternal organization, partnership or any other kind of organization, engaged in the sale and distribution of alcoholic beverages.
RULES AND REGULATIONS: Rules and regulations made and promulgated by the Montana department of revenue or the department of justice pursuant to Montana Code Annotated.
SALE AND SELL: Exchange, barter, and traffic. These terms also include the selling or supplying or distributing, by any means whatever, of liquor, by any partnership or by any society, association, or club, whether incorporated or unincorporated, and whether heretofore or hereafter formed or unincorporated, to any person, partnership, society, association or club or to any member thereof.
STATE LIQUOR STORE: A retail store operated by the department of revenue for the purpose of selling distilled spirits and wines.
TABLE WINE: Wine that contains not more than sixteen percent (16%) alcohol by volume and includes cider.
WINE: An alcoholic beverage made from the normal alcoholic fermentation of the juice of sound, ripe fruit or other agricultural products without addition or abstraction, except as may occur in the usual cellar treatment of clarifying and aging, and that contains more than one-half of one percent but not more than twenty four percent (24%) of alcohol by volume. Wine may be ameliorated to correct natural deficiencies, sweetened, and fortified in accordance with applicable federal regulations and the customs and practices of the industry. Other alcoholic beverages not defined in this section but made in the manner of wine and labeled and sold as wine in accordance with federal regulations are also wine.
