A. All Beverage License: Except as otherwise provided by law, a license to sell liquor, beer and wine at retail, an all beverage license, in accordance with the provisions of this chapter and regulations of the Montana Department of Revenue, may be issued to any person, in accordance with the provisions of this chapter and the regulations of the Montana Department of Revenue; each licensee licensed under this chapter shall pay an annual license fee of five-eighths (5/8) of the amount charged by the State of Montana for the license issued by the State of Montana to such person or persons. B. Beer And Wine: Except as otherwise provided by law, a license to sell beer at retail or beer and wine at retail, in accordance with the provisions of this chapter and regulations of the Montana Department of Revenue, may be issued to any person in accordance with the provisions of this chapter and the regulation of the Montana Department of Revenue; each licensee licensed under this section shall pay therefor an annual license fee of one hundred dollars ($100.00) for beer and two hundred dollars ($200.00) for beer and wine. C. Prorated Fees; Refunds: Provided however, that where a license, as specified in subsections A and B of this section, is issued for a period commencing subsequent to the first of the current year for which such license may be issued, a pro rata fee only shall be charged for the balance of such year, but nothing herein shall be construed to entitle any licensee hereunder to any refund of any portion of the license fee in the event of his discontinuing such business, or the suspension or revocation of his license, prior to the expiration of such year, except and save that he shall be entitled to a pro rata refund in the event that his business is discontinued by virtue of said act being, by referendum petition, rendered inoperative awaiting such time it may be passed upon at an election, and the determination and declaration of the result as provided by law.
