A. Stormwater Drainage System; Stormwater Drainage System Fund: The city hereby creates and establishes the system. The city intends to construct the system as required to implement the purpose of this chapter. The city hereby creates a stormwater drainage system fund to be used as provided herein and into which the stormwater fees and charges, including, but not limited to, the stormwater drainage charge and system permit and plan fees, shall be deposited (the "stormwater drainage system fund"). The stormwater drainage system fund will consist of various funds or accounts as determined by subsequent resolution or resolutions of the city.
B. Stormwater "Service Area": The city limits as may be adjusted from time to time shall constitute the storm drain system service area (the "storm drain system service area"). The city reserves the right to plan for drainage improvements outside the storm drain system service area and may also construct storm drainage improvements outside the storm drain system service area when needed as an integral part of the storm drain facilities.
C. Cooperation With The County: The city shall, in all ways and within the limits of its powers, solicit the board of county commissioners of Toole County, Montana, to cooperate in providing drainage facilities in stormwater basins, or parts thereof, extending outside the city and in general to carry out the drainage plan developed therein.
