11-5-2: DEFINITIONS:
The following definitions of terms shall apply unless the context clearly indicates another meaning or unless elsewhere expressly stated for specific application:
DETENTION/RETENTION BASINS: A normally dry area designed to capture and hold stormwater. The stormwater may be captured and released at a uniform rate after the storm peak flow has passed (detention) or the stormwater may be held for evaporation or infiltration into the ground and not released at all (retention).
DRAINAGE PLAN: A plan prepared by any developer of property in the city whose development qualifies as specified herein. The drainage plan consists of drainage calculations and mitigation of stormwater drainage. The plan includes contour lines as necessary and explicitly describes the stormwater drainage system, including any required detention areas. The plan and calculations shall use current hydraulic hydrology practices and shall conform with the stormwater drainage master plan.
HAZARDOUS SUBSTANCES: Caustic, poisonous, flammable or other material that may be dangerous to the public safety and welfare. Hazardous materials shall be defined by the United States environmental protection agency (U.S. EPA) and the Montana department of environmental quality ("Montana DEQ").
IMPERVIOUS AREA: The area of a parcel calculated in square feet by adding the areas of the building roofs, concrete, decks, asphalt, and other impervious surfaces situated on the property.
INITIAL STORMWATER IMPROVEMENTS: The existing stormwater drainage network and improvements that are currently hooked into the sanitary sewer system and which will be ultimately segregated from the sanitary sewer system and incorporated into the new and expanded stormwater drainage system upon completion of construction thereof.
MANMADE OR OPEN FLOW DRAINAGEWAY: An open channel designed to carry stormwater.
NATURAL DRAINAGEWAY: A recognizable drainage which has historically carried storm or runoff water. The drainageway may still be in its native state or may be partially or totally encroached upon. The limits of the drainageway are considered to be the outermost area of flow for the design storm and/or the prescribed easement for the drainageway.
OPERATION AND MAINTENANCE EXPENSES: The current expenses, paid or accrued, of operation, maintenance and minor repair of the system, excluding principal of and interest on bonds and depreciation, as calculated in accordance with generally accepted accounting principles, and shall include, without limitation, administrative expenses of the city relating solely to the system, premiums for insurance on the properties thereof, labor and the cost of materials and supplies used for current operation and for maintenance, and charges for the accumulation of appropriate reserves for current expenses which are not recurrent regularly but may reasonably be expected to be incurred.
STORM DRAINAGE MASTER PLAN: The plan described by the May 2012 "Preliminary Engineering Report - Shelby Storm Water Facilities" prepared by Kadrmas, Lee & Jackson, which is hereby adopted by reference and declared to be part of this chapter. The plans are on file in the office of the city clerk. The city may adopt additional drainage plan updates or modifications by reference. Modifications of the plans may be initiated by the mayor and submitted to the city council for approval. Approved, modified or updated plans shall be filed in the office of the city clerk. The cost of installing stormwater facilities in the city limits shall be charged in whole or in part against the appropriate property in the city limits.
STORMWATER DRAINAGE: An overland flow of water as a result of rain, snow, hail storms or rapid snowmelt or other surface water event.
STORMWATER DRAINAGE CHARGE: The fee described in section 11-5-9 of this chapter.
STORMWATER DRAINAGE MANAGER: The city superintendent or, if other than the city superintendent, a city employee designated by the mayor. The stormwater drainage manager shall be responsible for the operation, maintenance, capital improvements, and all other functions of the stormwater utility.
STORMWATER DRAINAGE SYSTEM: The infrastructure system which regulates and transmits storm and surface water through the city. The system includes curbs and gutters, drop inlets, culverts, open flow channels, detention/retention basins, natural drainageways, storm drain pipes, and related appurtenances. The stormwater drainage system will initially consist of the initial stormwater improvements, which will ultimately be integrated into the newly constructed stormwater drainage system.
STORMWATER DRAINAGE SYSTEM FUND: The fund established in subsection 11-5-3A of this chapter, into which the stormwater fees and charges shall be deposited.
SYSTEM: The stormwater and drainage system owned, operated, and maintained by the city consisting initially of the initial stormwater improvements and to consist of a newly constructed and expanded stormwater and drainage system, into which the initial stormwater improvements will ultimately be integrated, to address the matters described in subsection 11-5-1A of this chapter, as such system shall exist from time to time.
SYSTEM PERMIT AND PLAN FEES: The fee or fees to be established by the city council pursuant to a resolution in an amount sufficient to cover costs of the review of the drainage plans and the issuance of permits. (Ord. 827, 8-22-2016, eff. 9-21-2016)
