5-2-3: UNLAWFUL TRANSACTIONS 1 :
   A   “Intoxicating Substance” 2 means a controlled substance, as defined in Title 50, chapter 32, of the Montana Code Annotated, including but not limited to marijuana, and an alcoholic beverage, including but not limited to a beverage containing ½ of 1% or more of alcohol by volume.
   B.   A person commits the offense of unlawful transaction if he knowingly:
      1.   Explosives: Sells or gives explosives to a child under the age of majority except as authorized under appropriate city ordinances; or
      2.   Intoxicating Substances: Sells or gives intoxicating substances as defined by this section to a person under the age of 21 except as permitted by the State of Montana; or
   3.   Junk Dealer, Pawnbroker or Secondhand Dealer 3 : Being a junk dealer, pawnbroker or secondhand dealer, he receives or purchases goods from a child under the age of majority without authorization of the parent or guardian.
   C.   Penalty Any person in violation of any part of this section is guilty of a misdemeanor. (1975 Code § 9.76.010; amd. Ord. 851, 2-21-2023)
