5-2-2: LIQUOR 1 :
   A.   Visiting Bar Or Tavern: It is unlawful for any person under the age of eighteen (18) years to enter or visit any bar, tavern or other establishment where beer or liquor is sold for on premises consumption, or to loiter about or remain at such establishment, unless such person is accompanied by a parent, spouse or legal guardian. (1975 Code § 9.72.010)
   B.   Permitting To Visit Bar Or Tavern: It is unlawful for any person owning or operating a bar, tavern or any other establishment where beer or liquor is sold for on premises consumption, or any agent or employee of such person who is working or employed in or about such bar, tavern or other establishment where beer or liquor is sold for on premises consumption, to permit any person under the age of eighteen (18) years to enter or visit such establishment, or to loiter about or remain therein, unless such person is accompanied by a parent, spouse or legal guardian.    C.   Purchase:
      1.   Definition: The words "beer", "wine" and "liquor" as used in this section shall be defined in accordance with the definitions given in the Montana retail liquor act and the Montana beer act, and amendments thereto. (1975 Code § 9.72.030)
      2.   Purchase Prohibited: No person under the age of eighteen (18) years shall purchase any beer, wine or intoxicating liquor. (1975 Code § 9.72.040)
      3.   Misrepresentation Of Age: It is unlawful for any person under the age of eighteen (18) years to knowingly misrepresent his age by any means whatsoever for the purpose of obtaining beer, wine or intoxicating liquor. (1975 Code § 9.72.050)
   D.   Unlawful Possession:
      1.   Prohibited; Exception: A person who has not reached the age of majority commits the offense of possession of intoxicating substance if he knowingly has in his possession an intoxicating substance; except, a person who has not reached the age of majority does not commit the offense of possession of an intoxicating substance when in the course of his employment, he bags, carries or transports beer for customers at a grocery store.       2.   Penalty: Any minor violating the provisions of this subsection shall be dealt with in accordance with the juvenile laws of the state. (2008 Code)
