(a) The City hereby authorizes the Service Director, through the Service Department, to undertake the removal and to cause the removal of trees within the City in the event that the City determines that a tree or trees must be removed due to an emergency situation. An emergency shall be deemed to exist when, in the opinion of the Mayor, the removal of a tree or trees within the City is necessary to avoid the imminent likelihood of damage to property located in the City and/or injury to persons within the City.
(b) The trees contemplated to be removed, pursuant to this section are trees that are located on property belonging to the City and/or in the rights of way of the City.
