4-104: PERMITS REQUIRED:
   A.   Any person keeping or desiring to keep any horse, mule, donkey, cow, calf, hog, sheep, goat, chicken, turkey, or similar animal or fowl must secure a permit from the town.
      1.   Any person desiring to own or keep any fowl in town must first apply for and obtain a permit from town clerk. Permit must have signatures of fifty one percent (51%) of people residing in the area before approval of permit.
      2.   Any person filing an application to keep any fowl in town must provide proof of an existing enclosure for keeping fowl which must be pre-approved by the Board of Trustees of the Town of Shattuck, before the permit may be issued.
      3.   No more than six (6) fowl per yard shall be permitted by the town.
      4.   No roosters shall be permitted by the town.
      5.   No owner shall permit any fowl owned, harbored, or kept by him to be at large; and it is unlawful for any fowl to be at large at any time within the town.
   B.   Applicants for a permit for construction of an animal or fowl enclosure not existing on July 11, 1988, shall file with the town clerk-treasurer a petition requesting permission for an animal or fowl pen or other enclosure, the petition to be signed by at least fifty one percent (51%) of those people residing within said designated area. The clerk-treasurer shall collect a fee for each animal or fowl enclosure permit, the fee to be established by motion or resolution of the town board of trustees. The town board of trustees shall approve or disapprove the issuance of the permit after due consideration at a regular meeting of the board.
   C.   It is the duty of any police officer to request the exhibition of a permit from anyone keeping or harboring any of the animals listed in subsection A of this section and to enforce the provisions of this chapter against any person found to be in violation of the same.
   D.   Applicants for a permit for an animal or fowl enclosure existing July 11, 1988, shall make application for the permit with the town clerk-treasurer. The applicants shall not be required to file a petition as set forth above. However, if a petition be filed with the clerk-treasurer bearing the signatures of the owners of at least fifty one percent (51%) of those people residing within said designated area, requesting that the enclosure and the animal or animals therein be removed then the town board of trustees shall notify the owner and shall hear the petition at a regular meeting of the board and shall order or disapprove the removal of the animals after due consideration. Provided that the owner of any such preexisting animal and enclosure shall at all times conform with all duly enacted conditions as to the place and manner of keeping of such animals.
