12-306: EXEMPTIONS:
   A.   These floodplain management rules and regulations shall not apply to the use of the usual farm buildings for agricultural purposes, the planting of agricultural crops, the construction of farm ponds or the construction of uninsurable outbuildings.
   B.   New storm cellars may be built below the regulatory flood elevation and shall be exempt, provided that such new storm cellars are:
      1.   Limited to nonhabitable uses;
      2.   Designed so that all electrical, heating and other mechanical equipment is above the 100-year flood protection elevation;
      3.   Designed so that the integrity of the storm cellar is preserved during flooding; and
      4.   Compliance with requirements of subsections B1 through B3 of this section must be certified by a registered professional engineer or licensed architect. (1985 Code; amended 1987)
