12-303: GENERAL PROVISIONS:
   A.   The provisions of these rules and regulations shall be held to be minimum requirements. Larger floods may occur on rare occasions. Flood stages may be increased by manmade or natural causes, or combinations such as logjams and bridge openings restricted by debris. These rules and regulations do not imply that areas outside the regulatory floodplain or construction and development within such floodplain will be free from all flooding or flood damages.
   B.   These rules and regulations shall not be deemed nor construed to create any liability on the part of the floodplain board or planning commission or any officer or employee thereof for any flood damages which might be alleged or claimed to have occurred or sustained as a result of reliance on these rules and regulations or any administrative decision lawfully made thereunder.
   C.   Any structure or dwelling unit within a floodplain that existed prior to the date of approval of these regulations which does not meet the minimum standards set forth herein may continue. However, unless brought into compliance with the minimum standards set forth herein, such prior uses may not be substantially improved. (1985 Code; amended 1987)
