§ 31.17  TOWN ADMINISTRATOR.
   The Town Administrator shall be the Chief Administrative Officer of the town and shall be responsible to the Mayor and the Board of Commissioners for administering all municipal affairs placed in his/her charge by either the Mayor or Board of Commissioners.
   (A)   With approval of the Board of Commissioners, the Mayor may hire a Town Administrator.
   (B)   Except as modified by the terms and provisions of a written contract of employment, should one be entered into, the Town Administrator shall be deemed an employee at will.
   (C)   The position of Town Administrator is an “Executive, Administrative and Professional” position as defined in Part 541 of CFR, Chapter 29, otherwise known as the “Fair Labor Standards Act of 1983 as amended in 1985” and such, the Town Administrator is not entitled to compensation for work hours over and beyond the weekly hours defined in the wage and hour law.
   (D)   The Town Administrator, subject to administering all municipal affairs placed in his/her charge by the Mayor and/or Board of Commissioners, shall have the following duties and authorities:
      (1)   Recommend appointment or removal to the Board of Commissioners of all town officers and employees not elected by the people, and whose appointment or removal is not otherwise provided for by law, except the Town Attorney, in accordance with such general personnel rules, regulations, policies, and ordinances as the Board may adopt;
      (2)   Direct and supervise the administration of all departments, offices, and agencies of the town, subject to the general direction and control of the Mayor and Board of Commissioners, except as otherwise provided by law. It shall be the responsibility of the Town Administrator to keep the department heads generally informed of the workings and activities of the Board;
      (3)   Attend all meetings of the Board of Commissioners, Planning Board, Board of Adjustment, and any other town committees and recommend any measures that he/she deems expedient;
      (4)   See that all laws of the Town of Sharpsburg including the charter, ordinances, resolutions, and regulations of the Board of Commissioners are faithfully executed within the Town of Sharpsburg;
      (5)   Prepare in work sessions with the Board of Commissioners and the Finance Officer/Town Clerk the annual budget and the capital program not later than May 31 of each year. He/she shall then submit the annual budget and capital program in open session not later than the first regular June meeting of the Board of Commissioners;
      (6)   Submit annually to the Board of Commissioners and make available to the public a complete report on the finances and administrative activities of the Town of Sharpsburg as of the end of the fiscal year;
      (7)   Make any other reports that the Board of Commissioners may require concerning the operations of the town departments, offices, and agencies subject to the Town Administrator's supervision, directions, or management;
      (8)   Have the authority to expend funds without prior approval of the Board of Commissioners according to the terms and conditions of the annual budget ordinance and other financial policies adopted by the Board of Commissioners of the town. He/she shall report to the Board of Commissioners not later than the next regularly scheduled meeting each and every expenditure made without prior approval of the Board of Commissioners; and
      (9)   Perform any other duties that may be required or authorized by the Board of Commissioners off the Town of Sharpsburg.
   (E)   When the position of Town Administrator is vacant, the Board of Commissioners may designate a qualified person to exercise the authorities and perform the duties of Town Administrator until the vacancy is filled or until the Board of Commissioners removes the Interim Administrator.
