§ 115.17  FAILURE TO OPERATE WITH REGULARITY.
   (A)   (1)   Every person having obtained a permit to operate a taxicab shall be required to operate the taxicab in business with reasonable regularity.
      (2)   Reasonable regularity shall be defined as a minimum of 72 hours per week that the vehicle used in the operation of the permit must be available for service.
      (3)   The permit of every taxicab operator shall be subject to revocation if the operator fails to operate the taxicab with reasonable regularity for any period of 60 days.
      (4)   Every operator of a taxicab who fails to operate with reasonable regularity shall be given ten-days’ notice to appear before the Board of Commissioners to show just cause why the permit should not be revoked.
      (5)   The notice shall be made by certified mail to the permit holder.
      (6)   If delivery is refused, no further notice is required.
      (7)   The operator may request an automatic 14-day continuance before the matter is heard.
      (8)   If, upon the hearing, it shall appear that the taxicab is not being operated in the interest or the convenience and necessity of the public and not being operated with reasonable regularity, the Board of Commissioners is authorized to revoke the permit.
   (B)   Hours and days of operation of every valid permit shall be consideration in the decision to issue or not issue additional certificates as provided in § 115.40.
