When any ordinance is passed directing the laying or constructing of any sidewalk, and when the street or part thereof upon which the same is to be constructed is ready to receive the same, the persons hereafter mentioned shall give notice to the property owners to lay or construct the sidewalk in front of their respective premises within thirty days from the time of the serving of such notice. In case of failure, neglect or refusal of the property owners to lay or construct or cause to be laid or constructed the sidewalk in front of their respective premises, the same shall be laid by the City at the cost and expense of the owners of the property in front of or along which the respective sidewalk is laid and the cost and expense of the work and materials, together with a penalty of ten percent, shall be collected from the property owners in an action in assumpsit or by filing a lien therefor in court and proceeding therein as provided by law.
