(A) Failure to obtain permit. Pursuant to I.C. 36-1-24-18, an owner who rents a short-term rental without first obtaining a valid permit from the City Planning and Zoning Department commits a class C infraction. Each short-term rental transaction that the short-term rental provider completes without a short-term rental permit constitutes a separate violation of this chapter.
(B) Failure to comply with this chapter. Except for the violation stated in division (A) above, failure to comply with the other terms and conditions of this chapter shall be deemed to be a violation of this chapter and subject to a fine as set forth in § 118.05.
