§ 35.08 SIDEWALK FUND.
   (A)   There is now established in the Office of the Clerk-Treasurer a non-reverting fund to be known as the Sidewalk Fund.
   (B)   This Fund shall be under the control of the Department of Public Works, and is subject to the following conditions:
      (1)   All monies received from donations for the construction, re-construction and maintenance of public sidewalks shall be accepted and deposited into the Fund.
      (2)   All disbursements made from this Fund shall be for or on behalf of the Department of Public Works, and used solely for construction, reconstruction and maintenance of public sidewalks within the boundaries of the city, and in accordance with the rules established by the Board of Public Works and Safety for the 50/50 Sidewalk Program. These disbursements shall be made on the order of the Board of Public Works and Safety to the Clerk-Treasurer, and payable upon presentation of proper claims as specified in § 30.40 of the City Code.
