§ 35.08 SIDEWALK FUND.
   (A)   There is now established in the Office of the Clerk-Treasurer a non-reverting fund to be known as the Sidewalk Fund.
   (B)   This Fund shall be under the control of the Department of Public Works, and is subject to the following conditions:
      (1)   All monies received from donations for the construction, reconstruction and maintenance of public sidewalks and curbs shall be accepted and deposited into the Fund.
      (2)   The sum of $15,000 shall be deposited by the Clerk-Treasurer in the Sidewalk Fund as previously established by the City Council.
      (3)   All disbursements made from this Fund shall be for or on behalf of the Department of Public Works, and used solely for construction, reconstruction and maintenance of public sidewalks and curbs within the boundaries of the city, and in accordance with the rules established by the Board of Public Works and Safety for the Shared Cost Sidewalk Program. These disbursements shall be made on the order of the Board of Public Works and Safety to the Clerk-Treasurer, and payable to applicant upon presentation of proper claims as specified in § 30.40 of the City Code.
