§ 156.41 VALIDITY OF APPROVAL.
   (A)   Time periods. Approvals granted under the terms of this chapter shall be valid for the time periods indicated on Table 1 below.

   (B)   Expiration. In the event that the required action is not taken within the specified time period, the approval shall be null and void.
   (C)   Extensions. The Board of Works may grant a maximum of three extensions of time, with each extension not to exceed 18 months, only if the applicant demonstrates to the of the Board of Works that there are extenuating circumstances that necessitate or justify the extension. The applicant must request such extension before the expiration of the approval period.
   (D)   Phasing. The Commission in consultation with the Board of Works may allow a subdivision to be developed in phases. The applicant shall request phasing and provide a phasing schedule at the time of filing for primary approval. The applicant shall demonstrate that each phase has utilities, drainage, streets, and other improvements meeting the standards of this chapter. In no case shall the Commission approve a phasing plan in which any phase is dependent upon improvements proposed to be made in a future phase. If the Commission approves the development to be completed in phases, secondary approval of each phase shall automatically extend the deadline for secondary approval of subsequent phases for an additional 18 months.
