§ 35.60 LAW ENFORCEMENT CONTINUING EDUCATION FUND.
   (A)   There is established in the Office of the Clerk-Treasurer of the city a non-reverting fund known as the Law Enforcement Continuing Education Fund, pursuant to I.C. 36-1-3 et seq. The Fund is to be controlled by the Chief of Police and the Board of Public Works and Safety.
   (B)   The purpose of the Law Enforcement Continuing Education Fund is for the payment of training costs for the city Police Department and its officers pursuant to I.C. 5-2-1 et seq.
      (1)   The funds are derived from court costs paid to the County Clerk by defendants in the Circuit Court and Superior Court.
      (2)   Distribution of money for the Law Enforcement Continuing Education Fund shall be made without the necessity of first obtaining an appropriation from the City Council. To make a claim, the city Police Department will submit to the County Auditor a verified statement of case numbers for fees collected that are attributable to the efforts of the city Police Department. The city Police Department shall submit this claim for fees in the same fiscal year in which the fees are collected.
      (3)   All monies derived from these fees shall be utilized for the continuing education and training of officers of the city Police Department.
   (C)   All disbursements from the Continuing Education Fund shall be for the purposes stated above as defined by the Indiana Code. These disbursements shall be made upon the order of the Board of Public Works and Safety and payable by the Clerk-Treasurer upon presentation of proper claims.
