(A) There is established in the Office of the Clerk-Treasurer of the city a non-reverting fund known as the city Fire Department Hazardous Waste Clean-Up Fund, pursuant to I.C. 36-1-3 et seq. The Fund is to be controlled by the Chief of the city Fire Department.
(B) The purpose of the Hazardous Waste Clean-Up Fund is for the receipt of monies received for hazardous waste clean-up conducted by the Fire Department.
(C) All claims for disbursement from this Fund must be approved by the Board of Public Works and Safety. Distribution of money from the Hazardous Waste Clean-Up Fund shall be made without the necessity of first obtaining an appropriation from the City Council.
(D) Monies from the Hazardous Waste Clean-up Fund shall be utilized for the following purposes only:
(1) Hazardous waste education;
(2) Hazardous waste training; and
(3) To replace hazardous waste equipment.
(E) A hazardous materials response fee structure shall be implemented for the use of the city’s services as set forth in Ch. 36 of this code.
