(A) Purpose. This section is enacted with the purpose of protecting and providing for the health, safety, and general welfare of the citizens of the city who utilize the City Hall, all pursuant to the terms and provisions of I.C. 16-41-37-1 et seq., which is also known by the title Clean Indoor Air Law.

(B) Application. The provisions of this section shall apply to City Hall providing that building comes within the scope of the definition of public building pursuant to I.C. 16-41-37-2, which is an enclosed structure or part of an enclosed structure that is occupied by an agency of state or local government, but regardless that public building must be occupied or otherwise owned or under the control of the city.

(C) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
SMOKING. The carrying or holding of a lighted cigarette, cigar, pipe, or any other lit smoking equipment, or the inhalation or exhalation of smoke from any lit smoking equipment as is defined in I.C. 16-41-37-3.

(D) Smoking prohibited; smoking areas.
(1) In City Hall, smoking, as defined in I.C. 13-1-13, is prohibited in lobbies, hallways, and stairwells.
(2) In all offices of City Hall, smoking is prohibited in all counter areas.

(E) No smoking in meeting and hearing rooms. Regardless of any other provision of this section, when any room in City Hall is used for a public meeting or hearing, there shall be no smoking in that room during the meeting or hearing.

(F) Violations. A person who smokes in a public building except as in an area designated as a smoking area, in violation of this section, does commit a Class C infraction pursuant to the provisions of I.C. 16-41-37-4.
