(A) The planning, replanning, development, and redevelopment of economic development areas:
(1) Are public and governmental functions that cannot be accomplished through the ordinary operations of private enterprise because of the necessity for requiring the proper use of land so as to best serve the interests of the city and its citizens, and the costs of these projects;
(2) Will benefit the public health, safety, morals, and welfare, increase the economic well being of the city and the state, and serve to protect and increase property values in the city and the state; and
(3) Are public uses and purposes for which public money may be spent and private property may be acquired, all as provided and authorized by the Act.
(B) (1) There is created and established as part of the governmental organization of the city, a Department of Redevelopment controlled by a board to be known and legally designated as the Seymour Redevelopment Commission.
(2) The Seymour Redevelopment Commission shall consist of a board of five commissioners, three of which shall be appointed by the Mayor and two of which shall be appointed by the City Council. The Mayor shall also appoint an individual to serve as a nonvoting adviser to the Redevelopment Commission. The Seymour Redevelopment Commission is hereby authorized to undertake and carry out all purposes authorized or permitted pursuant to I.C. 36-7-14.
(C) Each redevelopment commissioner shall serve for one year from the first day of January after appointment until a successor is appointed and has qualified.
(D) A redevelopment commissioner or a nonvoting adviser appointed by the Mayor may not have a pecuniary interest in any contract, employment, purchase, or sale made by the Seymour Redevelopment Commission. However, any property required for redevelopment purposes in which a commissioner or nonvoting adviser has a pecuniary interest may be acquired, but only by gift or condemnation. A transaction made in violation of this subsection is void.
(E) The board shall meet and organize as by law provided. The redevelopment commissioners shall hold a meeting for purposes of organization annually on the first day in January that is not a Saturday, a Sunday, or a legal holiday.
