§ 114.12 VIOLATIONS; NOTICE TO ABATE.
A person who violates this chapter or knowingly allows a junk yard, junk facility, or junk place to be established or maintained on his or her property in violation of this chapter, shall suffer the following penalties. Whenever the Board of Public Works and Safety is given written notice by one of the responsible departments, that a junk yard, junk facility, or junk place is maintained or operated in violation of this chapter, the city shall give 30 days’ notice, by certified mail, to the owner of the property upon which the violation exists. If the owner fails to act within 30 days as required in the notice, the person failing or refusing shall become liable and forfeit to the city a fine, to be recovered by the city in a civil action brought in a proper court by the City Attorney. Each day’s delay in complying with the requirements in the notice shall constitute a separate violation of the chapter and result in additional liability. The penalty shall be paid into the General Fund for the use of the city.
