(A) (1) At the discretion of the supervisor, each petition to vacate a county road rights-of-way or county utility easement, or any segment thereof, shall be accompanied by a nonrefundable petition fee in the amount set forth in the most current fee schedule issued by the Supervisor pursuant to the requirements of this section.
(2) Other fees and charges, including, but not limited to, liability and indemnity insurance policies and performance bonds, for the matters referenced in division (B) below may be charged by the Supervisor against the applicant as the process required by this subchapter proceeds, with timely collection of such charges up front being required of the applicant as a condition for proceeding forward in the process.
(B) (1) Fees required under this section shall be determined and updated from time to time by the Supervisor, upon periodic review and approval by the Board of County Commissioners, with fees to be fixed in an amount reasonably calculated to compensate the county for costs and time incurred in inspecting and reviewing the petition to vacate, along with all of the documentation required to be submitted in with the petition and during the process of reviewing and acting on the petition, including, but not limited to, costs for security, liability insurance and indemnity and performance bonding, costs for legal review, costs of complying with all of the notice requirements of this subchapter and costs of engineers, construction personnel and other qualified consultants deemed necessary by the Supervisor to review and advise regarding the feasibility and technical aspects of any proposed road or utility easement vacating.
(2) The Supervisor shall prepare and distribute an updated schedule of fees required under this subchapter and may amend the fee schedule from time to time upon review and approval by the County Commission, as needed to reflect changing conditions.
(C) All petitions, fees, bonds or guarantees, insurance policies and other documents required by this subchapter shall be delivered to the County Road Department office, presently located at 689 West 2630 South, Richfield, Utah 84701.
