§ 152.49 VACATION BY PETITION.
   (A)   Any interested person or entity as defined herein, including the county itself, may petition to vacate some or all of a county road rights-of-way or county utility easement by submitting a written, dated and signed petition and any associated fees to the County Road Department.
   (B)   A written, dated and signed petition to vacate a county road rights-of-way or county utility easement, or any segment thereof, shall include:
      (1)   For each county road rights-of-way or segment thereof sought to be vacated:
         (a)   The road’s name and its corresponding county road number;
         (b)   A description of each segment of the road, if vacating less than the entire road is desired, stated in sufficient detail to allow identification of each segment in question; and
         (c)   A map depicting, with reasonable accuracy and specificity, the location of the road or road segment.
      (2)   For each county utility easement or segment thereof sought to be vacated:
         (a)   The easement’s name and any county identifying number or classification;
         (b)   A description of each segment of the utility easement, if vacating less than the entire easement is desired, stated in sufficient detail to allow identification of each segment in question; and
         (c)   A map depicting, with reasonable accuracy and specificity, the location of the county utility easement or segment thereof.
      (3)   The name and address of each interested person or entity as defined herein;
      (4)   Proof of written notice to all interested persons or entities who are utilities as defined herein; and
      (5)   The signature of each interested person or entity named in the petition who consents to the proposed vacation.
