(A) The County Board of Commissioners recognizes that emergency conditions may arise from time to time requiring an emergency encroachment upon a county road rights-of-way.
(B) An applicant in such emergency conditions may proceed with the emergency encroachment work, provided:
(1) The applicant shall notify the County Sheriff’s Office Dispatch at once and make diligent efforts to notify the Supervisor as soon as possible concerning the situation;
(2) The applicant shall complete and submit the required application for an appropriate encroachment permit on the next working day following commencement of the encroachment work;
(3) The encroachment work may continue if the application has been made unless and until the Supervisor orders the applicant to cease further encroachment work;
(4) The applicant will incur no penalty with the county if an application for encroachment has been timely and properly made as required in this section. Otherwise, all fees will be assessed at twice the normal amount; and
(5) All emergency work shall strictly comply with all standards set forth in this subchapter.
