5-1-7: PROHIBITION OF ANIMALS AT SPECIAL EVENTS:
   A.   Definitions: For the purpose of this section, each of the following terms shall have the meaning herein ascribed to it:
 
ANIMAL:
Something that lives and moves but is not a human being, which includes, but is not limited to, dogs, cats, birds, rodents, snakes, reptiles, horses, mules and goats.
SENECA DOWNTOWN BUSINESS DISTRICT:
From Douglas Street south to Union Street, and from Commerce/Vaughey Street west to village city limits, all within the village of Seneca.
SPECIAL EVENT:
Shipyard Days, Cruise Night, or such other community events held in the downtown business district, as may be designated by the Seneca village council.
 
   B.   Animal Prohibition At Special Events:
      1.   It shall be unlawful for any person to allow an animal to be located in the Seneca downtown business district during Seneca Shipyard Days, regardless of whether said animal is leashed or otherwise restrained, except as may be allowed herein.
      2.   It shall be unlawful for any person to allow an animal to be located in the Seneca downtown business district during Cruise Night, regardless of whether said animal is leashed or otherwise restrained, except as may be allowed herein.
      3.   Animals expressly excluded from the provisions of this section shall be as follows:
         a.   Dogs which are part of a police canine unit or mounted law enforcement units which utilize horses.
         b.   A "service animal" as defined in the Americans with disabilities act or "guide dog", "seizure alert dog", "seizure response dog" or "hearing dog" as set forth in the Illinois guide dog access act 1 or the Illinois white cane law 2 .
         c.   Animals which are: 1) part of an entertainment act; 2) approved participants in a public parade; or 3) are used for transportation of vehicles.
         d.   Those animal owners whose residence lies on the streets defined under the Seneca downtown business district and have no other means of ingress and egress for their animals.
      4.   Any person found in violation of this section shall be fined a sum of not less than one hundred dollars ($100.00), nor more than seven hundred fifty dollars ($750.00). Whenever a monetary fine is assessed by the court pursuant to this code, the court is further expressly authorized by the village of Seneca to use dispositions including, but not limited to, court supervision, deferred judgment, conditional discharge, and suspended sentence.
      5.   In addition to the above fine, any member of the Seneca police department or other designated law enforcement agency working any such special event is hereby authorized to impound said animal, either with or without the assistance of the LaSalle or Grundy County animal control, for a reasonable period of time, only after providing the animal owner or person in possession of same with notice of the alleged violation and a reasonable opportunity to be heard.
      6.   The animal owner shall be responsible for the payment of all fees associated with said impoundment and shall pay the same prior to the release of the animal from impound. Any such fee shall be in addition to the required fine set forth in subsection B4 of this section. (Ord. 14-04, 8-19-2014)
