5-1-3: ANIMALS AT LARGE; IMPOUNDMENT AND REDEMPTION:
   A.   Animals At Large Prohibited:
   1   .   It shall be unlawful for any dog or cat to run at large within the village including, but not limited to, streets, sidewalks, village owned parks, fields, common areas, or boat ramp areas. Any animal found outside the lot lines of the premises occupied by its owner or keeper shall be deemed to be running at large unless such animal is firmly held on a leash or is in an enclosed vehicle. The owner or keeper of any animal found running at large in violation of this section shall be subject to the penalty set forth in subsection D of this section.

      3.   It shall be unlawful for any person to suffer or to permit any vicious, ferocious or dangerous animal, or dog or cat sick with or liable to communicate any contagious or infectious disease, or any dog or cat which may unduly disturb the quiet of any person or neighborhood within the village, or which shall bite any person or injure any person, to run at large in the village. That running at large of any dog or cat is hereby declared to be a nuisance 1 . The mayor or any commissioner, officer or agent of the village is authorized and it shall be the duty of the village police and of such other officers or persons as the mayor may from time to time designate, to abate said nuisance.    B.   Animals To Be On Leashes Or Confined: (Rep. by Ord. 03-13, 6-3-2003)
   C.   Removal Of Excrement: All excrement deposited by the animal must be cleaned up and properly disposed of by the owner or keeper of the animal from public property or other person's private property. (Ord. 86-15, 11-18-1986)
   D.   Disposition Of Dogs And Cats At Large: All dogs and cats running at large in violation of subsection A of this section shall be restrained by the village and notice of such action shall forthwith be given to the owner or keeper of such animal if known. If the owner or keeper cannot be reached, or does not immediately retrieve the animal, the animal will then be delivered to a local veterinarian for handling. Fees shall be charged as follows:
      1.   If the animal is retrieved by the owner or keeper prior to being delivered to a veterinarian the sum of fifty dollars ($50.00) will be charged to the owner.
      2.   If the animal is delivered to a veterinarian, the sum of ninety dollars ($90.00) will be charged to the owner and, in addition, the owner will be responsible for retrieving the animal from the veterinarian and any fees the veterinarian shall impose.
      3.   If the fine is not paid as stated above, and court action is initiated, then the owner shall pay those fines as set out by village ordinance, together with applicable court costs (section 5-1-7 of this chapter). (Ord. 17-01, 1-3-2017)
