157.11   ENFORCEMENT.
The enforcement officer is authorized to enforce the requirements of this chapter and may utilize any of the following when it is determined that any person, entity or applicant who engages in construction land disturbing activities upon any site does not meet the requirements of this chapter:
   1.   A municipal infraction citation for violation of this Code of Ordinances.
   2.   Legal (civil) action including an action for injunctive relief may be pursued.
   3.   A fine for payment of the actual cost to the City for the following:
      A.   Removing sediment from public facilities and restoring the same to their original condition.
      B.   Restoring drainage ways, storm water drainage or runoff channels to allow the proper drainage flow.
      C.   Professional fees for investigation of alleged violations of this chapter, drainage complaints and recommendations for remedial action to bring property into compliance.
   4.   An order to terminate activities due to failure to implement or maintain pollution control best management practices, failure to comply with the approved SWPPP or Erosion and Sediment Control Plan or failure implement appropriate erosion and sediment control measures required by this chapter.
   5.   No building permits for the site shall be issued until the violations are corrected, and current building permits for the site may be rescinded.
   6.   No permanent certificates of occupancy shall be issued for the site until the violations are corrected. Any existing temporary certificate of occupancy may be rescinded.
   7.   Violations may be reported to the Department of Natural Resources or other responsible State or Federal agency.
   Nothing contained herein shall limit the right of the City to any other remedy available to the City for the enforcement of this chapter.
