1. Each applicant or its successor shall be responsible for installing and maintaining all storm water management facilities and features which were approved by the City during site plan review and as set forth herein following completion of construction.
2. No occupancy permit shall be issued by the City for a property which is or was the subject of an NPDES permit unless water quality and quantity components addressed in the applicant’s best management practices and SWPPP as required by this chapter are installed and operating as proposed by the applicant.
3. Each property for which an occupancy permit or final inspection is sought shall fully comply with all existing requirements promulgated by the IDNR in connection with water quality and quantity components required to be addressed by the City as part of its MS2 Permit; and shall comply with all other applicable City, State or Federal permit requirements as they apply to the City or to the property.
4. For sites equal to or greater than one acre, each applicant must provide to the City an as-built certification that storm water management facilities were built as stated in a SWPPP that includes the site. For sites less than one acre that are part of a common plan of development and for which the applicant establishes that storm water management facilities were or will be built to address all properties (either collectively or individually) within the development, each applicant must provide to the City a copy of the Notice of Discontinuation for General Permit No. 2 applicable to the property.
5. In the event the applicant and the City agree that storm water systems installed by applicant to meet its requirements pursuant to this chapter are to be dedicated to the City, the City shall prepare a dedication agreement on such terms and conditions as the City determines, in its sole discretion, are appropriate, including the requirement that the applicant pay all costs and fees, including reasonable attorneys’ fees and consultant fees, incurred by the City in connection with said dedication. The City may impose such other charges and bonding requirements as it deems reasonably required to assure the performance of the storm water systems.
6. At the discretion of the City, the applicant may satisfy the post-construction storm water management requirements by ensuring the conveyance of the storm water discharge from the property to a regional detention facility.
