§ 75.99 PENALTY.
   (A)   Except as otherwise provided in this chapter, a person who is convicted of a violation of § 75.02(A), (B) or (C) above is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not less than $100, nor more than $500, or both, together with costs of prosecution. As part of the sentence for a violation of § 75.02(A) or (B), the court shall take action on the person's driver's license as provided for in M.C.L. § 257.625(4).

   (B)   A person convicted of a violation of this chapter is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $300, or both, together with costs of the prosecution. As part of the sentence for a violation of this section, the court shall take action on the person's driver's license, as provided for in M.C.L. § 257.625(b)(2).
