The rates and charges set forth in this subchapter notwithstanding, if the character of the sewage of any user imposes an unreasonable or additional burden upon the sanitary sewer system of the village, an additional charge shall be made over and above the rates otherwise. Waste water in excess of the maximum limitations imposed by this subchapter shall be deemed prima facie subject to surcharge. If necessary to protect the system or any part thereof, the village shall deny the right of any user to discharge sewage into the sewer system.
(A) Surcharge rates. Surcharge rates for BOD, total suspended solids, total phosphorous as P and ammonia nitrogen are hereby established as follows:

(B) Surcharge rate payment. The rates stated herein shall be effective on September 1, 2010, except as otherwise provided. A billing covering the use of the system before and after the effective date of a rate change shall require the proration of the bill based on the average use per day and the number of days within the billing period at the rate then in effect. Surcharges shall be collected with the sewer billings. The rates established herein for surcharge rates may be revised by the Village Council by resolution and shall establish when the rates shall be billed and paid.
