§ 20.13 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALL-TERRAIN VEHICLE. A motor vehicle designed to travel on three or more wheels and designed primarily for off-road use but not including farm tractors, construction equipment, forestry vehicles or lawn and grounds maintenance vehicles.
   DEMOLISHER. A person licensed under Iowa Code Chapter 321H whose business it is to convert a vehicle to junk, processed scrap or scrap metal or otherwise to wreck or dismantle vehicles.
   HOBBY VEHICLE. Motor vehicles not required to be licensed, including, but not limited to, dragsters, stock cars, Indy-type racers, midget racers, all-terrain vehicles, dune buggies, go-carts or competition pulling garden or farm tractors. For the purpose of this subchapter, golf carts, boat trailers, common utility trailers, camping trailers or snowmobile trailers and any other motor vehicles required to be licensed are not considered HOBBY VEHICLES.
   JUNK. All old or scrap copper, brass, lead or any other non-ferrous metal; old or discarded rope, rags, batteries, paper, trash, rubber, debris, waste or used lumber or salvaged wood; dismantled vehicles, machinery and appliances or parts of such vehicles, machinery or appliances; iron, steel or other old or scrap ferrous materials; old or discarded glass, tinware, plastic or old or discarded household goods or hardware. Neatly stacked firewood located on a side yard or a rear yard is not considered JUNK.
   JUNK/ABANDONED VEHICLE. Any of the following:
      (1)   A vehicle that has been left unattended on public property for more than 24 hours and lacks current registration plates or two or more wheels or other parts which renders the vehicle totally inoperable;
      (2)   A vehicle that has remained illegally on public property for more than 24 hours;
      (3)   A vehicle that has been unlawfully parked or placed on private property without the consent of the owner or person in control of the property for more than 24 hours;
      (4)   A vehicle that has been legally impounded by order of a police authority and has not been reclaimed for a period of ten days. However, a police authority may declare the vehicle abandoned within the ten-day period by commencing the notification process;
      (5)   Any vehicle parked on the highway determined by a police authority to create a hazard to other vehicle traffic;
      (6)   A vehicle that has been impounded pursuant to Iowa Code § 321J.4B by order of the court and whose owner has not paid the impoundment fees after notification by the person or agency responsible for carrying out the impoundment order; and/or
      (7)   A vehicle which has any of the following characteristics:
         (a)   Any vehicle not capable of being driven from the place of its location under its own power without the addition of parts or repair thereon;
         (b)   Any vehicle not equipped with four inflated tires;
         (c)   Any vehicle with a broken, missing or loose fender, door, bumper, hood, steering wheel, window, trunk lid or windshield;
         (d)   Any vehicle which has become the habitat for rats, mice or snakes, or any other vermin or insects;
         (e)   Any unlicensed or inoperable vehicle which contains gasoline or any other flammable fuel; and
         (f)   Any vehicle not displaying a current year license plate, one month after such license is required, or not legally placed in storage with the County Treasurer.
   MUNICIPAL INFRACTION. Any violation of this code. A MUNICIPAL INFRACTION shall include the doing of any act prohibited or declared by this code to be unlawful, an offense or a violation of said code, or any omission or failure to perform any act or duty required by said code. A MUNICIPAL INFRACTION shall also include any violation of any uniform code or ordinance adopted by the city by reference. A MUNICIPAL INFRACTION is punishable by civil penalty as provided herein, or by the Iowa Code.
   OFFICER. Any employee or official authorized to enforce this code. For the purpose of this chapter, any member of the City Council, including the Mayor, is an OFFICER as defined herein.
   POLICE AUTHORITY. The State Patrol or any law enforcement agency of a county or city.
   REPEAT OFFENSE. A recurring violation of the same ordinance or section of this code by the same offender and/or property owner.
   VEHICLE.
      (1)   Every device in, upon or by which any person or property is or may be transported, including, but not limited to, automobiles, trucks, travel trailers, motor homes, motorcycles, golf carts, boat trailers, common utility trailers, camping trailers, snowmobile trailers, riding lawnmowers, garden tractors or farm tractors.
      (2)   VEHICLE does not include:
         (a)   Any device moved solely by human power; or
         (b)   Any device used exclusively upon stationary rails or tracks.
