§ 91.37 KEEPING OF DOGS.
   (A)   The keeping of one or two dogs, four months old or older, is permitted without any permit or site improvements.
   (B)   The keeping of three dogs, four months or older, is prohibited, except by permission of the City Commission.
   (C)   Any person desiring to keep three dogs, four months or older, within the city shall make application to the City Commission in writing for permission so to do, describing particularly the place where the applicant proposes to keep the dogs, the distance from that place to the public streets on each side, and the distance to the dwelling houses upon the lands adjoining the proposed place. The city shall charge an application fee as set by resolution.
   (D)   All applications to keep three dogs, four months or older, shall be referred to the City Manager who shall make a report and recommendation to the City Commission. If it shall appear to the City Commission that it will not be detrimental to the health, safety, and welfare of any of the inhabitants of the city, the City Commission shall grant a permit to the person applying therefor, to keep three dogs within the city. The permit shall specify the place where the dogs may be kept. No person shall keep three dogs in the city contrary to the terms and conditions of the permit. The City Commission may revoke the permit whenever it may deem it fit and proper to do so, upon good cause shown.
   (E)   It is unlawful for any person to keep or harbor more than three dogs, four months old or older, on any lot, premises, dwelling, building, structure, or living accommodation.
   (F)   A violation of this section shall be a municipal civil infraction.
