§ 51.04 ESTABLISHING A NATURAL GAS PIPELINE DAMAGE PREVENTION PROGRAM.
   (A)   (1)   Before any party or parties shall excavate, blast, bore, tunnel, backfill, or remove above- ground structures by either mechanical or explosive means or engage in other earth-moving operations in the city, such party or parties shall file an application for a permit for such activity, providing the following information: the name of the owner of the property; the location of the property; the nature of the excavation planned and the manner in which it will be completed; and the approximate time such excavation will be performed.
      (2)   (a)   This application shall be filed with the City Gas Department, City-County Building, Scottsville, Kentucky.
         (b)   The applications shall be indexed in the names of the property owners. Applications shall be filed at least 24 hours, excluding Saturdays, Sundays, and holidays, prior to the beginning of any excavation activity.
   (B)   (1)   The city shall compile and maintain in a current status the names and addresses of parties who normally engage in excavation activities in the city.
      (2)   The list shall be updated on an annual basis. Such parties shall be given actual notice of this section by certified mail.
   (C)   Any party giving notice by application of his, her, or its intent to excavate in areas having buried pipelines shall be given notice of the location of such pipes by telephone and certified mail and the pipelines in the area shall be marked by stakes having clear and identifiable signs marked gas line.
   (D)   Any pipeline that could be damaged by excavation activity shall be thoroughly inspected by the City Gas Department before the pipes are covered or backfilled. Any excavation by blasting shall be inspected for damage to the line by a leakage survey of the affected area.
   (E)   The general public shall be notified of this program by periodic publication of the pertinent provisions of this section and by broadcasting the same via local radio.
   (F)   The city may elect to participate in a public service program or one-call system.
