(A) The filing of a development plan shall constitute an agreement between the Planning Commission and the persons signing the application, their heirs, successors, personal representatives and assigns that:
(1) If the zoning map amendment is enacted the binding elements of the development plan will be strictly adhered to;
(2) Building permits for improvements of the property in question shall be applied for and issued only when in conformance with the binding elements of the development plan. The filing for a building permit not in conformance with these provisions shall constitute a breach of agreement enforceable by the Planning Commission or appropriate legislative body.
(B) The binding elements placed on the general development plan shall be strictly complied with and be enforceable in the same manner as any of the elements of this chapter.
