§ 153.070 SPECIAL ACCESSORY USES.
   The following is special accessory use:
   (A)   A swimming pool as an accessory use to a residential structure shall be located no closer than ten feet to the rear property line and no closer than ten feet to a side property line. On a corner lot the side yard setback shall be equal to one-half the distance of the right-of-way of the side street, but no less than 25 feet. The setback shall be measured from the wall of the swimming pool to the nearest property line.
   (B)   The swimming pool area must be enclosed by a fence or other suitable barrier with a minimum height of not less than four feet. Openings in the fence shall be small enough to prevent a child from entering the enclosure other than through the gate.
