(A) Applicability. The following shall be subject to this chapter:
(1) Cellular antenna towers;
(2) Broadcast towers;
(3) Telecommunications support towers; and
(4) Point-to-point microwave towers;
(5) Ground-mounted switchboxes, relay stations, or facilities used for switching, transmitting, re-transmitting, or controlling telecommunications signals.
(B) Exclusions. The following are not regulated by the provisions from this chapter:
(1) Receive-only antennas and amateur radio facilities that are owned and operated by a federally-licensed amateur radio station operator are not included in this category;
(2) Radio and television studios are classified as business activities;
(3) Radio and television broadcast facilities that are public safety facilities are classified as basic utilities;
(4) Ground and post-mounted telephone switch boxes not exceeding six feet in height are classified as basic utilities.
