§ 113.99 PENALTY.
   (A)   Any person who violates any provision of this chapter for which no specific penalty is provided, shall be guilty of a misdemeanor and for the first offense, be fined not less than $100 and not more than $200, or be imprisoned in the County Jail for not more than six months, or both; and for the second and each subsequent violation, shall be fined not less than $200 or more than $500, or be imprisoned in the County Jail for not more than 12 months, or both. If the person who violates any provision of this chapter is a corporation, limited liability company, partnership, joint stock company, association, or fiduciary, then the President and/or the principal officers, members, or partners responsible for such violations may be punished by imprisonment as authorized by this section.
   (B)   Upon any conviction of any person for the violation of any offense in this chapter, all property held in violation of this chapter, and any personal property, including, but not limited to, books, video tape, films, and other property used in the commission or furtherance of an offense under this chapter shall be forfeited as provided in KRS 500.090 by court order and sold, destroyed, or otherwise disposed of in accordance with KRS 500.090.
